Most people shopping for a container in Winter Haven are comparing sizes and day rates. The city's solid waste chapter is having a different conversation.

Under the code, all garbage and refuse accumulated in the city is collected by the city government, and no one may collect or convey refuse for a fee over city streets without a temporary commercial collection permit issued by the city. The same chapter says that large containers, commonly called dumpsters, shall be leased from the city, and that other large containers may be provided by commercial haulers only where a permit has been obtained.

So before anyone talks about a ten-yard or a twenty, there is a prior question: who is putting the can on your property, and under what authority?

Six Answers Before You Book Anything

Does Winter Haven really require a permit for a private hauler?
Yes, and it reaches more than containers. The code requires one for anybody collecting, conveying, or disposing of refuse for a fee inside the city. The permit itself is an exception rather than a counter service: where unusual circumstances exist in which the city is unable to provide efficient and practical commercial collection, the city may grant a temporary commercial collection permit on a hauler's application, for a term of up to a year, renewable.
Then where does that leave you?
It leaves you with a question worth asking about any container quote you are comparing. The city's own application form requires a permitted hauler to remit 20% of what it bills you to the city every month and to complete an application, with a fee, for every container it places. That cost falls under the permitted container price, whether or not the quote breaks it out. A loaded haul that arrives, fills and leaves the same day is not a container placement, and it is not the product that carries those costs.
Can I just rent one from the city?
Yes, and for a lot of jobs that is the straightforward route. The city rents 20- and 30-yard roll-offs on a per-pull basis with a delivery charge, leases smaller dumpsters, and publishes those rates in its annual solid waste fee schedule. Call the Solid Waste Division on (863) 291-5756 and ask.
Can I haul my own?
The chapter says so in as many words. It does not prohibit the actual producers of refuse, or the owners of premises where refuse has accumulated, from personally collecting, conveying and disposing of it, provided they comply with the chapter and with other applicable law. In practice, that means a Polk County resident taking the load to the county's transfer station off K-Ville Avenue, on the north side of the landfill site, in a car, a small truck, or a utility or enclosed trailer, which is what the county says that gate accepts.
Then what do you do?
We load and haul. On a great many Winter Haven jobs, the container was never the right product anyway. A trailer that arrives, is filled by machine, and leaves the same day does not sit in your driveway for a week, does not need to be screened, and does not have a permit term attached to it.
What if it needs to go in the street?
That is a different permission again. Nobody other than a city employee may build, repair, move, or remove any structure on, in, or under a street or its adjacent right-of-way without a permit from the City Manager.

Placement Is a Code Question Before It Is a Space Question

The pad, and the line it may not cross

A commercial container belongs on the customer's property, on a concrete pad to the engineering division's specification, out of the right-of-way. On a lot with a short driveway and a canal or a seawall behind the house, that constraint decides the job before anyone measures the container.

Screening, and the two exemptions

The land development code treats dumpsters as a screened installation: any new installation, change in use, change in business, or replacement has to comply and be inspected and approved by the Solid Waste Division. Two things are exempt. A dumpster behind the principal structure, or a hundred feet or more from the roadway, is exempt from screening where a minimum six-foot wall or opaque fence stands between it and any residentially or recreationally zoned property. And a temporary construction dumpster is exempt while an active permit is in effect on the property. Where neither fits, a waiver is granted by the Economic Opportunity and Community Investment Director, on a Development Review Committee finding that screening is physically infeasible.

Which is why the two permits expire together

The construction-dumpster exemption is tied to the building permit being active, and the container's collection permit is capped at the same term. When the construction permit closes, the container loses the right to stand there and to stand there unscreened at the same time.

A container cannot go through a side gate at all. It sits where a truck can set it down, which on most lots means the driveway, and everything behind the house has to be carried out to it by hand. A mini skid steer goes through the gate instead and brings the load out to the trailer. The comparison is not between container sizes; it is about whether anyone is carrying anything.
