Winter Haven's building division puts a sentence on its permit paperwork that most cities keep for demolitions only. Each building permit for demolition or renovation, it says, must contain an asbestos notification statement indicating the owner's or operator's responsibility to comply with section 469.003 of the Florida Statutes and to notify the Department of Environmental Protection of the intention to remove asbestos, where applicable.

What Counts as a Facility, and Why That Word Is Doing the Work
The federal asbestos rule attaches to renovations and demolitions of a facility. The state's guidance defines a facility as any institutional, commercial, public, industrial, or residential structure, installation, or building, while excluding isolated residential buildings with four or fewer dwelling units.
The exclusion is narrower than the unit count alone suggests. The department publishes four further conditions with it: the building must not be part of a larger project involving multiple residential buildings, must not have been used for commercial purposes in the past, must not be demolished to make room for a commercial structure, and work on more than one small residential building on the same site by the same owner or operator is subject to the rule.
The prior-commercial-use condition is the one that applies to older houses, and Winter Haven has plenty of houses that were once shops, clinics, or offices.
And what counts as a renovation is broader than people expect
The state's guidance is explicit that a renovation could be any interior renovation or remodel that does not affect load-supporting structural members, or a roof replacement. Stripping a commercial kitchen or pulling the ceiling out of a shop is, in the regulations' language, a renovation of a facility.
Where the Numbers Sit, and Where They Do Not Apply
The survey comes first
For a facility, the state requires the owner or operator to complete a survey of the affected part of the building for asbestos before the planned renovation or demolition begins, and that the survey be conducted by a licensed asbestos consultant. It is waived under the thresholds and inside the residential exemption. We stop for it. We do not perform it.
The three quantities, and the case where they do not matter
The demolition row is the one contractors get wrong. The quantities gate a renovation. A demolition of a facility carries the notice whether or not a survey finds anything at all.
The fee changed in 2025
The department revised the state asbestos rule effective March 23, 2025, and now charges a flat fee for a notification submitted on paper or where a pay-later invoice is generated, with a discount where it is submitted electronically and paid at the time. The current amounts are on the department's own notice page.
